Fire Stopping Surveyors Ltd ("FSS")

These Terms & Conditions apply to all quotations, orders and works undertaken by Fire Stopping Surveyors Ltd unless otherwise agreed in writing. Acceptance of our quotation, instruction to proceed, issue of a purchase order, confirmation of programme dates, or permitting works to commence shall constitute acceptance of these Terms & Conditions.

1. QUOTATION VALIDITY
Unless otherwise stated, quotations are valid for 30 days from the date of issue. FSS reserves the right to revise pricing after this period, particularly where labour, material, access or programme requirements have changed.

2. PAYMENT TERMS
A 30% deposit is payable upon receipt of order/instruction, unless otherwise agreed in writing. The remaining 70% balance is payable upon completion of the works.

Alternative payment arrangements may only be applied where expressly agreed in writing by FSS.

FSS reserves the right to suspend works or withhold certification, reports or other project documentation where payments are overdue, subject to applicable contractual and statutory requirements.

3. ACCEPTANCE & INSTRUCTION TO PROCEED
Acceptance of this quotation may be evidenced by written acceptance, email instruction, purchase order, confirmation of programme/start dates, or other clear instruction for FSS to mobilise or undertake the works.

By accepting the quotation, the Client confirms acceptance of the scope, price and these Terms & Conditions.

4. CANCELLATIONS, POSTPONEMENTS & ABORTIVE VISITS
Once attendance dates have been agreed, labour and resources will be allocated to the project.

Cancellations or postponements made with less than 48 working hours' notice may be charged at a standard rate of £420.00 + VAT per operative, per day, or the actual reasonable costs and losses incurred by FSS as a result of the cancellation/postponement, where greater.

Where FSS attends site and is unable to commence or continue the works due to circumstances outside our control, including but not limited to the site not being ready, access being unavailable, other trades preventing access, incomplete enabling works, permits not being available, or areas being unsafe or inaccessible, the attendance may be treated as an abortive visit.

Abortive visits may be charged for all associated labour, travel, accommodation, subcontractor, plant and other reasonable costs incurred.

Any return visit will be subject to availability and may require a revised programme.

5. SITE READINESS & ACCESS
The Client is responsible for ensuring that all areas are ready and accessible for the agreed commencement date.

Unless specifically included within our quotation, the Client shall provide suitable access to the work areas, including any required permits, inductions, isolation arrangements and coordination with other trades.

Delays resulting from restricted access or circumstances outside FSS's reasonable control may result in additional charges.

6. VARIATIONS & ADDITIONAL WORKS
The quotation covers only the works specifically described within the scope.

Any additional works, changes in quantities, specification changes, design changes, additional attendances or works identified following commencement may be treated as a variation and charged additionally.

Where practicable, variations will be agreed before the additional works are undertaken. Where immediate action is required to maintain programme or site safety, FSS will notify the Client as soon as reasonably practicable.

7. MATERIAL QUANTITIES & SURVEY INFORMATION
Pricing is based upon the information, drawings, schedules, quantities and site conditions available at the time of quotation.

Where actual site conditions or quantities differ materially from those provided or reasonably visible at quotation stage, FSS reserves the right to revise the quotation or submit a variation.

8. PARKING, CONGESTION CHARGES & ULEZ
Unless expressly stated as included within the quotation, parking charges, congestion charges, ULEZ charges, tolls and similar site/location-specific charges will be charged additionally at cost.

Where parking is required, the Client should provide suitable on-site parking wherever reasonably possible.

9. MILEAGE & TRAVEL
Where travel or mileage is not expressly included within the quotation, additional mileage may be charged at FSS's applicable mileage rate.

Significant additional travel caused by programme changes, abortive visits, additional attendances or changes requested by the Client may be charged additionally.

10. ACCOMMODATION
Where overnight accommodation is reasonably required to undertake the works, accommodation costs will be charged to the Client unless specifically stated as included within the quotation.

Any additional accommodation costs resulting from programme changes, delays, cancellations or additional attendances outside FSS's control may also be charged.

11. WORKING HOURS
Unless otherwise stated, pricing is based upon works being completed during normal working hours.

Evening, night, weekend or bank-holiday working may incur additional charges and will be agreed separately.

12. MAKING GOOD & DECORATION
Making good, plastering, decorating, painting and other finishing works are excluded unless specifically identified within the quotation.

FSS will endeavour to leave completed works in a suitable and professional condition within the scope of the works instructed.

13. FIRE STOPPING & FIRE DOOR WORKS
Fire stopping and fire door works will be undertaken in accordance with the specified or agreed tested systems, manufacturers' installation requirements and applicable third-party certification requirements where relevant.

FSS does not accept design responsibility unless specifically appointed in writing to provide a design service.

Where a proposed detail falls outside a tested system or manufacturer's published detail, additional technical or manufacturer approval may be required before works can proceed.

14. THIRD-PARTY CERTIFICATION & RECORDS
Where included within our quotation, installation records, photographic evidence, inspection information and certification will be provided following completion of the relevant works and completion of FSS's quality assurance process.

Certification relates only to works undertaken and/or inspected by FSS within the agreed scope.

15. CONCEALED CONDITIONS
FSS cannot accept responsibility for conditions concealed behind walls, ceilings, floors, existing fire stopping, finishes or other building elements that could not reasonably have been identified prior to commencement.

Any additional work required as a result of concealed conditions may be treated as a variation.

16. DELAYS
FSS will use reasonable endeavours to meet agreed programme dates. FSS shall not be responsible for delays caused by circumstances outside its reasonable control, including delays caused by other contractors, restricted access, unavailable areas, changes to the programme, material availability or Client instructions.

Additional costs arising from such delays may be chargeable where reasonably incurred.

17. WASTE & HOUSEKEEPING
FSS will maintain reasonable housekeeping within its working areas and remove waste generated directly by its works unless otherwise agreed.

Removal of existing materials, waste generated by others, specialist waste or general site waste is excluded unless specifically included within the quotation.

18. HEALTH & SAFETY
All works are subject to suitable and safe working conditions. FSS reserves the right to suspend or refuse works where conditions present an unacceptable health and safety risk.

Any costs resulting from delays caused by unsafe site conditions outside FSS's control may be chargeable.

19. TITLE TO MATERIALS
Where legally applicable, materials supplied by FSS remain the property of FSS until payment relating to those materials has been received in full. Risk in installed materials passes in accordance with the applicable contract and law.

20. LIABILITY
FSS shall not be responsible for defects, failures or losses resulting from works undertaken by others, incorrect information supplied by the Client or third parties, subsequent alteration or damage to completed works, or use of systems outside their tested or approved application.

Nothing within these Terms & Conditions excludes or limits liability where it would be unlawful to do so.

21. QUOTATION PRIORITY
Where there is any inconsistency between these standard Terms & Conditions and specific written terms expressly included within the quotation, the specific terms stated within the quotation shall take precedence.

22. GOVERNING LAW
Unless otherwise agreed in writing, this quotation and any resulting contract shall be governed by the laws of England and Wales, and the parties shall submit to the jurisdiction of the courts of England and Wales.

 

ACCEPTANCE

Acceptance of this quotation confirms acceptance of the scope of works, quoted price and these Standard Terms & Conditions.
